Terms and Conditions

Order:
By clicking the "Pay" button after selecting your tickets, you submit a contractual offer to us for a binding order. If we accept the contractual offer, you will generally receive a binding order confirmation with an order number within 24 hours of receipt of the order on working days. Cancellation of the contract is no longer possible after that. For leisure services provided on a specific date or during a specific period, there is generally no statutory right of withdrawal under Section 312g(2) no. 9 BGB.

Prices:
All prices stated include all costs. The stated prices include advance booking fees, system fees, VAT, any flat-rate charges for public transport and agency fees. Shipping costs are shown separately. Our prices may differ considerably from the original prices printed on the tickets because the tickets reach us through various intermediaries, each of whom charges their own mark-ups.

Best price guarantee:
For events marked with our best price guarantee, we guarantee that our price is the lowest worldwide. The basis for this is an order confirmation issued by us. If, within seven days of issue of this order confirmation, you purchase equivalent tickets for the same event from another provider at a lower price, i.e. tickets identical in original price and category, we will refund the difference between our price and that of the other provider. Online auction houses are excluded. The basis for this is a legally binding purchase agreement between you and the other provider in which binding delivery is guaranteed.

Delivery/seat category:
When several seated tickets are ordered, at least two seats will always be next to each other. Tickets are delivered either by registered mail, express delivery or email. Delivery is deemed binding if we can provide proof from the respective delivery service. In our experience, tickets sent by post arrive approximately 7 to 10 days before the event date, while tickets sent by email arrive 2 to 3 days beforehand. If you require a voucher or gift voucher in advance, we will be happy to issue one free of charge. For a small number of events, we reserve the right to leave the tickets at the hotel or to arrange another appropriate form of delivery at the event location on the day of the event. The categories listed by us are classified exclusively on the basis of the seating plans held by us, provided these are displayed on our website. We generally reserve the right to supply better, i.e. higher-quality, tickets if tickets in the ordered category are no longer available. Higher quality is defined by the original price printed on the ticket within the categories of the booked event or by the higher sales price stated by us. An exception is permitted only if these criteria are unreasonable for the purchaser. We do not charge any surcharge in these cases. If a hotel named by us is no longer bookable, we reserve the right to book an equivalent hotel nearby. For Oktoberfest seats, we generally reserve the right to move the booking to another tent.

Liability:
Ticketpool is liable without limitation in cases of intent and gross negligence and for culpable injury to life, body or health. In the event of a slightly negligent breach of essential contractual obligations, liability is limited to the typical, foreseeable loss. Otherwise, liability for slight negligence is excluded to the extent permitted by law. Mandatory statutory liability remains unaffected.

Legal basis in the event of impediments to performance (force majeure clause)
In the event of force majeure, the obligation to perform and the customer's claim for damages against Ticketpool shall lapse completely. The customer's right to withdraw from the contract when the force majeure becomes known is also excluded, since Ticketpool acts solely as an intermediary for all its services and is likewise unable to derive any independent claim for damages against the organiser.
Example: cancellation of a major event by regulatory authorities of any kind or by the organiser itself, or an event being held under more difficult conditions or with the public excluded (e.g. football matches or concerts). In such cases Ticketpool is generally not liable for any resulting damage because these measures can neither be influenced nor changed by Ticketpool.
Force majeure typically includes:
- floods
- earthquakes
- natural disasters of any kind (hurricane, severe storm, tornado)
- fire
- epidemics and diseases
- wars and civil wars
- embargoes
- possibly also short-term changes in the laws of the respective countries
Insofar as Ticketpool's liability is excluded or limited under the preceding paragraphs, this also applies to the liability of its agents and vicarious assistants.

Data protection:
Personal data are processed solely in accordance with applicable data protection law. Details on the nature, scope, purposes, recipients and retention periods can be found in our Privacy Policy at ds.php.

Returns / refunds / cancellation / postponement:
The return of properly supplied admission tickets or cancellation of a binding order is generally excluded unless there is a statutory or expressly agreed right of withdrawal, termination or refund. If an event is cancelled, refund claims are governed by the contractual circumstances, statutory law and, where applicable, the organiser’s conditions. A postponement does not automatically create a right to return tickets; mandatory statutory rights remain unaffected. Where original tickets must be returned for a refund, we will inform you of the applicable deadlines and conditions.

Jurisdiction / applicable law:
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of mandatory consumer protection provisions of the state of their habitual residence. Where the customer is a merchant, a legal entity under public law or a special fund under public law, Cologne shall be the place of jurisdiction to the extent permitted by law. Otherwise, the statutory places of jurisdiction apply.

Final provisions:
Should individual provisions of these terms and conditions be or become invalid, this shall not affect the validity of the contract as a whole. The law of the Federal Republic of Germany shall apply exclusively.
